1. Introduction and Acceptance of Terms

Welcome to drbatzdorf. These Terms of Use ("Terms") govern your access to and use of the digital products, services, and website provided by Dr. Batzdorf, an Einzelunternehmen registered in Germany ("we," "us," or "our").

By purchasing, downloading, or using our digital products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not purchase or use our products.

2. About Our Products
drbatzdorf offers digital products and live services including but not limited to:

- E-books on nutrition, sleep and health optimization

- Planning templates, guidance materials, and meal plans

- Live group masterclasses delivered via video conference (the "Masterclass")

Digital products are delivered electronically via email download link following purchase. Live services are scheduled events delivered at a specific date and time agreed at the point of booking.

3. Medical Disclaimer and Limitation of Advice

IMPORTANT: THIS IS NOT MEDICAL ADVICE

While the creator of drbatzdorf is a licensed medical doctor, the information provided in our digital products is for general educational and informational purposes only. It is NOT intended as medical advice, diagnosis, or treatment.

You acknowledge and agree that:

- The content provided represents general health information and education only

- No doctor-patient relationship is created through the purchase or use of these products

- The information is not a substitute for professional medical advice, diagnosis, or treatment

- You should always consult with your own qualified healthcare provider before making any health-related decisions or changes to your diet, exercise routine, or lifestyle

- Individual circumstances vary, and what works for one person may not be appropriate for another

- We do not provide personal consultations or individualized medical advice through these products

- If you have specific health concerns, medical conditions, allergies, dietary restrictions, or are taking medications, you MUST consult with your local healthcare provider before implementing any information from our products

- You should never disregard professional medical advice or delay seeking it because of information in our products

Special Populations:

- If you are pregnant, breastfeeding, have a chronic medical condition, eating disorder history, or any special health circumstances, you must obtain clearance from your healthcare provider before using the information in our products.

In Case of Emergency:

If you experience a medical emergency, call emergency services immediately. Do not rely on information from our products in emergency situations.

4. Eligibility and Legal Capacity

To purchase our products, you must:

- Be legally capable of entering into binding contracts under the laws of your jurisdiction

- Have the legal capacity to make online purchases

- Provide accurate and complete information during the purchase process

5. Intellectual Property Rights

All content included in our digital products, including but not limited to text, graphics, logos, images, meal plans, templates, and compilation of content (the "Content"), is the exclusive property of drbatzdorf and is protected by German and European intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to:

- Download and use the products for your personal, non-commercial use only

- Print copies for your personal use

You are expressly prohibited from:

- Reproducing, duplicating, copying, or reselling any portion of the Content

- Distributing, sharing, or making the Content available to third parties

- Creating derivative works based on the Content

- Removing or altering any copyright notices or proprietary markings

- Using the Content for any commercial purpose

- Uploading or sharing the Content on file-sharing platforms, social media, or websites

We retain all rights, title, and interest in and to our products and Content. Any unauthorized use terminates the license granted herein.

6. Purchase Terms and Pricing

- All prices are listed in Euros (EUR) unless otherwise stated

- Prices are subject to change without notice

- Payment must be completed before access to digital products is granted

- We reserve the right to refuse or cancel any order at our discretion

7. Delivery

Digital products will be delivered via email download link to the email address provided during purchase. You are responsible for:

- Providing a valid and accurate email address

- Ensuring your email system accepts our emails (check spam/junk folders)

- Downloading the products within the timeframe specified in the delivery email

- Maintaining secure storage of your downloaded files

We are not responsible for delivery failures due to incorrect email addresses, spam filters, or technical issues on your end.

8. Refund policy

This Section 8 applies to digital products only (e-books, templates, guidance materials, meal plans, and similar downloadable content). It does not apply to live services, including The Feel Well Masterclass, which are governed by Section 8a.

By completing your purchase and ticking the consent checkbox at checkout, you expressly consent to immediate delivery of the digital product and acknowledge that you lose your statutory right of withdrawal once download access has been granted.

Under § 356 Abs. 5 BGB and Article 16(m) of EU Directive 2011/83/EU, the statutory right of withdrawal for digital content not supplied on a tangible medium expires once performance has begun.

8a: Specific Terms for Live Masterclasses

The following terms apply specifically to The Feel Well Masterclass and any other live group session offered by drbatzdorf. Where these terms conflict with the general terms in this document, these specific terms prevail for live services.

8a.1 Nature of the Service

The Masterclass is a live, real-time educational event delivered via Zoom. It is a group format with a maximum of 30 participants per session. Each session is 90 minutes in duration.

The Masterclass is educational in nature. No doctor-patient relationship is created through your purchase or attendance. The medical disclaimer in Section 3 of these Terms applies in full to the Masterclass.

8a.2 No Recording

The Masterclass is delivered live only. We do not record sessions, do not provide replays, and do not make recordings available for purchase. By booking, you acknowledge that the Masterclass is a one-time live experience and that no recorded version exists or will be created.

8a.3 Booking, Confirmation, and Access

Bookings are confirmed only after full payment has been processed. Upon confirmation, you will receive a booking confirmation email containing the date, time, and Zoom registration link for your session. The registration link is also included in reminder emails sent before the session.

You are responsible for:

- Completing the Zoom registration in advance of your session

- Joining your session on time, with a working device, camera, microphone, and stable internet connection

- Ensuring our emails reach your inbox (check spam folders)

We are not responsible for missed sessions caused by technical issues on your end, incorrect email details, failure to register on Zoom, or any other circumstance within your control.

8a.4 Rescheduling Policy

You may reschedule your booking once, free of charge, into any future Masterclass session in the same language, provided:

- The reschedule request is made at least 24 hours before the start time of your originally booked session

- A future session in the same language is available within the published booking window

Rescheduling is permitted one time per booking. Subsequent reschedule requests on the same booking will not be honoured. Reschedules can be made via the link provided in your confirmation email.

8a.5 No-Show and Late Arrival

If you do not attend your booked session and have not rescheduled in accordance with Section 8a.4, your booking is considered fulfilled and no refund or credit will be issued. Late arrivals are welcome to join the session in progress, but no extension or make-up time will be provided.

8a.6 Refund Policy for the Masterclass

The Masterclass is a live service, not a digital download.

By completing your booking, you expressly request that the live service be performed at the scheduled date and time, and you acknowledge that you waive any statutory right of withdrawal (Widerrufsrecht) under § 356 Abs. 4 BGB and Article 16(a) of EU Directive 2011/83/EU once the service has been performed.

Refunds for Masterclass bookings will only be issued in the following circumstances:

- The session is cancelled by drbatzdorf and cannot be rescheduled to a session of your choice

- A technical failure on our end prevents the session from taking place and no alternative session is offered

- A legally required circumstance entitles you to a refund under applicable consumer law

In all other cases, including no-shows, late arrivals, change of mind, schedule conflicts arising after the 24-hour reschedule window, or dissatisfaction with the content delivered, bookings are non-refundable.

8a.7 Conduct During the Masterclass

To protect the experience of all participants, the following conduct is required during the Masterclass:

- Respectful communication with the host and other participants

- No recording, screenshotting, or otherwise capturing the session in any form

- No sharing of your registration link or join credentials with any third party

- No promotional, commercial, or solicitation activity in the chat or via private message

We reserve the right to remove any participant from the live session for breach of these conduct rules without refund.

8a.8 Capacity and Cancellation by drbatzdorf

Each Masterclass session is capped at 30 participants. We reserve the right to cancel or reschedule a session in cases of illness, technical failure, force majeure, or insufficient registrations. In the event of cancellation by drbatzdorf:

- You will be notified as early as possible via the email address provided at booking

- You will be offered a free reschedule into any future session in the same language

If no future session is acceptable, a full refund will be issued to your original payment method within 5 to 10 business days

8a.9 Privacy of Other Participants

The Masterclass is a group setting. Other participants may see your first name and may hear or read your questions and comments if you choose to speak or write in the chat. You agree not to capture, share, or distribute any information about other participants without their explicit consent. The privacy of all participants is protected, and breach of this clause may result in removal from the session and potential legal action.

8a.10 Intellectual Property

The content of the Masterclass, including but not limited to slides, frameworks, spoken content, and any materials shared during the session, is the exclusive property of drbatzdorf. The license terms in Section 5 of these Terms apply.

You are expressly prohibited from:

- Recording, transcribing, or otherwise capturing any portion of the live session

- Reproducing or sharing any content, materials, or frameworks taught during the session

- Using the content for any commercial purpose or in any third-party offering

9. Data Collection and Privacy

We collect names and email addresses as part of our sales process. The collection, processing, and storage of your personal data are governed by our separate Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and other applicable European and German data protection laws.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

10. Disclaimer of Warranties

OUR DIGITAL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- Warranties of merchantability or fitness for a particular purpose

- Warranties regarding accuracy, reliability, or completeness of content

- Warranties that the products will meet your specific needs or expectations

- Warranties of specific health outcomes or results

You acknowledge that individual results may vary and that we make no guarantees regarding weight loss, health improvements, or any other specific outcomes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

- Your use or inability to use our products

- Any health outcomes or lack thereof resulting from following information in our products

- Any errors or omissions in the content

- Any unauthorized access to your personal information

- Any other matter relating to our products or services

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless drbatzdorf, its owner, and any affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

- Your violation of these Terms

- Your use or misuse of our products

- Your violation of any rights of third parties

- Any health decisions you make based on information in our products

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or our products shall be subject to the exclusive jurisdiction of the courts located in Germany.

European Union consumers may also have the right to address their complaints to the European Online Dispute Resolution (ODR) platform.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our products after any changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and drbatzdorf regarding the use of our products and supersede all prior agreements and understandings.

17. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of drbatzdorf.
